WeAreHouse78 LLC ("WeAreHouse78," "we," "us," or "our") is committed to providing a safe and enjoyable experience for all attendees at our events and all users of our online platforms. These Terms of Service govern your use of our websites, applications, ticketing platforms, and in-person events, including house78.com, the9ambanger.com, and any subsidiary pages or platforms listed below.

Through the use of our websites and services, you are consenting to the following terms and conditions expressed within this agreement.
1. Acceptance of Terms
By accessing or using any website, service, application, or event operated by WeAreHouse78 LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Ticket Purchases and Refund Policy
All ticket sales are final. Refunds are not provided unless an event is cancelled or rescheduled by WeAreHouse78 LLC. In the event of a cancellation, refunds will be issued through the original point of purchase. WeAreHouse78 LLC is not responsible for lost, stolen, or damaged tickets. Tickets are non-transferable unless explicitly permitted by the ticketing platform.
3. Age Requirements and Event Entry
WeAreHouse78 LLC events are intended for guests who meet the legal drinking age in the jurisdiction where the event takes place. This includes but is not limited to 21 years of age in the United States, 19 years of age in Ontario, Canada, and the applicable legal drinking age in any other city or country where our events are held. Valid government-issued photo ID is required for entry at all events. WeAreHouse78 LLC reserves the right to refuse entry to any individual for any reason, including failure to comply with venue rules, age requirements, or the instructions of our staff and security personnel.
4. User Conduct
By attending our events or using our services, you agree to comply with all applicable local, state, provincial, federal, and international laws. You agree to follow all venue rules and the instructions of our staff and security personnel. You agree not to engage in any conduct that is disruptive, dangerous, or harmful to other attendees or staff. You agree not to use our services for any unlawful or unauthorized purpose.
5. User-Generated Content
When you post content publicly that tags, mentions, or references The 9AM Banger or any affiliated event series, you grant WeAreHouse78 LLC a non-exclusive, royalty-free license to display such content in our internal monitoring tools. We will always request your explicit permission before reposting your content to our channels or using it in paid advertising. You retain full ownership of your content at all times.
6. Intellectual Property
All content on our websites and social media channels, including logos, graphics, event branding, photographs, videos, and written content, is the property of WeAreHouse78 LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.
7. Third-Party Services
Our services may contain links to or integrations with third-party platforms including Posh, Instagram, Meta, TikTok, Twitter/X, Dropbox, Google, Laylo, and Live Nation. WeAreHouse78 LLC is not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is governed by their respective terms and policies.
8. SMS and Email Communications
By signing up for our mailing list or SMS updates, you consent to receive marketing communications from WeAreHouse78 LLC. You may unsubscribe at any time by following the instructions in any communication or by contacting us at weare@house78.com. Message and data rates may apply for SMS communications.
9. Disclaimers and Limitation of Liability
WeAreHouse78 LLC provides its services on an "as is" basis without warranties of any kind. To the fullest extent permitted by law, WeAreHouse78 LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your attendance at any event, your use of our services, or any third-party conduct at our events or on our platforms. Our total liability shall not exceed the amount you paid for the ticket or service giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless WeAreHouse78 LLC, its officers, employees, partners, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of our services, your attendance at our events, or your violation of these Terms.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts located in New York County, New York

12. Changes to These Terms
WeAreHouse78 LLC reserves the right to modify these Terms of Service at any time. We will notify users of significant changes by posting the updated terms on our website and updating the Effective Date. Your continued use of our services after any changes constitutes acceptance of the updated terms.
